Even if the magazine is using a promo shot from a hired photographer it should be credited and I think magazines should make sure that happens by not accepting photos from bands if the band doesn't give them the credit for it. So instead of e-mailing the band to ask for a photo they should e-mail the band ask for a photo and the name of the photographer and stress the fact that the photographer's name MUST be included with the shot. ultimately it's the magazine's responsibility because they're the ones who'll end up with a lawsuit when they print a photo that has a copyright. And if the magazine tries tries take the band or press guy at the label to court over that, nothing will happen because the magazine never asked the band for the photographers name. you don't see CD's without the engineers name in it.
