A lawyer, even court appointed, can get charges dropped. DA and prosecutors can only commute, continue, or lessen charges. ALWAYS ALWAYS ALWAYS get a lawyer for ANY JAILABLE OFFENSE, or anything that will affect your criminal record if found guilty. Pleading to a continuance for a first time DUI seems like a great idea, til you get pulled over 30 years later with a few beers on your breath and find out it STILL counts as a second offense, and can cost you a few years in jail. |

Something I've found out that some people may be interested in knowing. It is ILLEGAL for an officer to change the manner of a routine traffic stop ex:speeding, running a red light or a stop sign, etc etc. if you get pulled over for speeding, but then have your car searched, none of that can hold up if you claim that the officer changed the grounds of the stop. Also, it is illegal if you get held longer than the amount of time required to write a ticket for whatever violation you were pulled over for. This is actually a law in NH known as the Terry Stop. so..... I'd say even if this dosen't get dismissed immediately, I at least have some type of argument. Illegal search and seizure anyway. |
